These terms apply to requests and orders placed with van Rossum Sculptures.
1. Business details

2. The sculpture
Each portrait bust is:

Made to order from customer-supplied video and photographs
-
Created at approximately life-size scale
-
Built from precision-cut layers of lightweight wood
-
Finished with one coat of iQon Mano spray
-
A sculptural interpretation of the person’s likeness rather than a mechanical reproduction
Natural variations in wood, grain, tone, layer alignment and finish are part of the character of the piece.
3. Submitting material
The customer first submits an iPhone video through an iCloud link.
Submitting a video does not create an order or payment obligation. The material is first reviewed to confirm that it contains enough detail to create the sculpture.
A new video may be requested if the submitted material is unclear, incomplete or unsuitable.
For exact 1:1 scale, an additional front-facing photograph with a standard bank-card-sized card touching the underside of the nose is required.
4. Permission to use submitted images
The customer confirms that:

They are entitled to submit the videos and photographs

The person shown has given permission for the material to be used to create the sculpture

A parent or legal guardian has given permission where the person shown is under 18
-
They are entitled to provide the material where the person shown is deceased
The customer remains responsible for obtaining the necessary permission.
5. Order confirmation
If the submitted material is suitable, the customer receives:

Confirmation that the bust can be made
-
The selected options and any extra requests
-
The shipping price
-
The total price
-
A payment request
The order becomes binding when payment has been received and the order has been confirmed by van Rossum Sculptures.
6. Price and payment
The product price shown on the website excludes shipping unless stated otherwise.
Shipping is quoted separately based on the destination. The complete amount is confirmed before payment.
Payment must be received before work begins.
Possible additional charges are confirmed in advance and may include:

Detailed refinements

Review of the refined digital model

Modelling a separately filmed hat or glasses
-
Additional copies
-
Other substantial custom requests
A standard engraving on the back is included at no extra cost.
7. Refinements and digital-model review
Subtle natural refinement is included as standard.
More specific changes can be requested as an additional service, guided by earlier photographs or written comments. Where this service is selected, the refined digital model can be reviewed before the physical bust is made.
The customer must check the model carefully at this stage. Work begins after the model has been approved.
Requests made after approval may result in additional costs or a longer completion time.
8. Artistic interpretation
The customer accepts that the bust is an artistic interpretation created from the submitted material.
The final sculpture may differ slightly from:

The original person
-
Photographs or video stills
-
The reviewed digital model
-
Screen colours and website images
These differences can result from the wood, layered construction, cutting, assembly and finishing process.
This does not limit the customer’s legal rights where the finished sculpture is defective or materially different from the agreed description.
9. Completion time
The normal completion time is approximately 4–6 weeks after:

Payment has been received

All necessary files and information have been supplied

Any reviewed digital model has been approved
This is an estimate rather than a guaranteed delivery date.
The customer will be informed if an unexpected delay occurs.
10. Shipping and delivery
Shipping is arranged after the destination has been confirmed.
The customer is responsible for providing complete and accurate delivery details.
For deliveries outside the European Union, local import VAT, customs duties or handling charges may apply. Unless specifically included in the shipping quote, these charges are paid by the recipient.
Delivery times provided by the carrier are estimates.
11. Damage or defects
The customer should inspect the sculpture after delivery and report any damage or defect as soon as reasonably possible.
The report should include:

Clear photographs of the sculpture

Photographs of the packaging where transport damage is suspected
Where the sculpture is defective or does not conform to the agreed order, van Rossum Sculptures will provide an appropriate solution in accordance with applicable consumer law.
12. Cancellation and right of withdrawal
Each bust is made specifically from the customer’s submitted likeness and personal instructions.
Because it is clearly personalised and made to the customer’s specifications, the statutory 14-day right of withdrawal generally does not apply after the order has been confirmed.
Before payment, the customer may choose not to proceed without charge.
After payment, cancellation requests should be made immediately. Any possible refund depends on the work already completed and costs already incurred.
This section does not affect the customer’s legal rights where the sculpture is faulty or does not match the agreed order.
13. Additional copies
Additional copies may be ordered from the retained final fabrication files.
These are quoted separately and are available at a lower price than the original commission because the modelling work has already been completed.
Availability depends on the relevant files still being retained.
14. Intellectual property
Purchasing a sculpture transfers ownership of the physical piece but not the intellectual-property rights in:

The digital model

The design
-
The cutting or fabrication files
-
Photographs produced by van Rossum Sculptures
-
The production method
The sculpture and digital files may not be commercially copied, reproduced or manufactured without written permission.
A digital model supplied to the customer is for personal reference unless otherwise agreed in writing.
15. Privacy
Personal information, videos, photographs and digital models are handled according to the Privacy Policy.
Submitted portrait material is never published or used for promotion without separate, explicit permission.
16. Events outside reasonable control
van Rossum Sculptures is not responsible for delays caused by events outside reasonable control, including carrier disruption, equipment failure, supply shortages, illness, customs delays or other exceptional circumstances.
The customer will be informed and a reasonable solution will be sought.
17. Complaints
Questions or complaints should be sent to:

Complaints will be reviewed and answered within a reasonable period.
18. Applicable law
These terms are governed by Dutch law.
Consumers retain any mandatory protections provided by the law of the country in which they live. Nothing in these terms removes rights that cannot legally be excluded.
19. Changes to these terms
These terms may be updated when the service or legal requirements change.
The version applicable to an order is the version provided or published when that order is confirmed.
